These Terms & Conditions (“Terms”) govern your use of the Vape Well Australia website (the “Site”) and any purchase of products from Vape Well Australia (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. About us
The Site is operated by VapeWell Australia. You can contact us at info@vapewellaustralia.store; we respond to every message within one business day.
2. Age restriction — 18+ only
- The Site and our products are strictly for adults aged 18 years or older. By using the Site or placing an order you represent and warrant that you are at least 18.
- We use an age-verification gate and an 18+ checkout. We may request proof of age (government-issued photo ID) and may cancel any order and refuse service if age cannot be verified.
- You must not purchase products on behalf of, or make them available to, any person under 18. It is an offence in every Australian State and Territory to supply vaping products to minors.
3. Our products
- We sell disposable vaping devices and related products (the “Products”), including brands such as Alibarbar, IGET, HQD, Insta Bar and Wotofo. All Products are dispatched factory-sealed from Australian stock.
- Product information (descriptions, puff counts, flavours, images) is provided in good faith and may be updated by manufacturers without notice. Images are indicative only.
- Nothing on the Site is medical or therapeutic advice, and our Products are not supplied as therapeutic goods unless expressly stated.
4. Health warnings
- Products may contain nicotine, which is a highly addictive substance.
- Products are intended for adult users of vaping products. If you do not already use nicotine products, we strongly advise against starting.
- Do not use Products if you are under 18, pregnant or breastfeeding, or if you have (or are at risk of) heart disease, high blood pressure, or another medical condition, without first consulting a medical practitioner.
- Keep all Products out of the reach of children and pets. In case of accidental ingestion or adverse reaction, contact the Poisons Information Line on 13 11 26 (Australia) or emergency services on 000.
5. Compliance with laws
- Laws regulating the sale, import, possession and use of vaping products differ between the Commonwealth, States and Territories and change frequently. Some Products may be restricted or require a prescription in your location.
- You are solely responsible for knowing and complying with all laws that apply to you, including any prescription, import, possession and use requirements in your State or Territory. By ordering, you warrant that your purchase, receipt and use of the Products is lawful where you are located.
- We reserve the right to refuse or cancel any order, or to decline service to any person, at our discretion and without liability, including where we believe an order may not comply with applicable law.
6. Accounts and orders
- To order, you may be asked to create an account. You must provide accurate, current information and keep your login credentials secure. You are responsible for all activity under your account.
- An order is an offer to purchase. A contract is formed only when we dispatch the Products and confirm dispatch by email. We may accept or decline any order at our discretion.
- You must not misuse the Site, interfere with its security, or use it for any unlawful purpose.
7. Prices and payment
- All prices are in Australian dollars (AUD) and include GST unless stated otherwise.
- We take reasonable care to keep prices accurate, but a manifest pricing error does not bind us. If an error occurs, we will contact you to confirm the correct price or cancel and refund the order.
- Payment is required in full at the time of order via the payment methods offered at checkout. We may suspend or cancel orders where payment fails or fraud is suspected.
8. Shipping and delivery

- Every order ships with a tracking number. Dispatch timeframes are stated at checkout and are estimates only; delays outside our control (including carrier delays, customs or border controls, and natural disasters) do not constitute a breach by us.
- Risk in the Products passes to you on delivery. Title passes on payment in full.
- If a delivery fails because the address provided was incorrect or incomplete, or because the parcel was unclaimed, re-delivery costs are your responsibility.
- Deliveries require an adult (18+) recipient. Carriers may require signature and proof of age on delivery.
9. Returns, refunds and exchanges
- Our separate Refund and Returns Policy (vapewellaustralia.store/refund-and-returns/) forms part of these Terms, including its 30-day return window for items that are unused, factory-sealed and in original packaging.
- Nothing in these Terms or the Refund and Returns Policy limits or excludes rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) — see section 10.
10. Australian Consumer Law guarantees
- Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
- To make a claim, contact us at info@vapewellaustralia.store with your order number and details (and photos, where relevant) of the issue. We will respond within one business day.
11. Warranties and liability
- To the extent permitted by law, we exclude all conditions, warranties and representations not expressly set out in these Terms or required by the Australian Consumer Law.
- Where the Australian Consumer Law applies, our liability for a breach of a consumer guarantee is limited, for goods, to supplying replacement goods or paying the cost of replacing them, or repairing the goods or paying the cost of repair, as is appropriate in the circumstances.
- To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from misuse, modification, or use of Products contrary to these Terms, manufacturer instructions, or applicable law.
- You acknowledge that use of any vaping product involves health risks, and you use Products voluntarily and at your own risk.
12. Privacy
We collect, use and disclose personal information in accordance with our Privacy Policy (vapewellaustralia.store/privacy-policy/) and the Privacy Act 1988 (Cth), including the Australian Privacy Principles. We collect only the information needed to process orders, verify age, and provide support, and we do not sell your personal information.
13. Intellectual property
All content on the Site — text, graphics, logos, images and software — is owned by or licensed to us and protected by copyright and trade mark law. Brand names and marks of third-party manufacturers remain the property of their respective owners. You may not reproduce Site content for commercial purposes without our written permission.
14. Prohibited conduct
You must not: use the Site if you are under 18; provide false information (including about your age or identity); resell Products in breach of applicable law; attempt to interfere with the Site’s operation or security; or use the Site in any way that is unlawful, harmful, or infringes anyone’s rights.
15. Third-party links
The Site may link to third-party websites (for example, payment providers or delivery carriers). We are not responsible for their content or practices, and links do not imply endorsement.
16. Force majeure
We are not liable for delay or failure caused by events outside our reasonable control, including acts of government, changes in law or regulation, border or customs action, carrier failure, pandemics, or natural disasters.
17. Changes to these Terms
We may update these Terms from time to time, including to reflect changes in law or our business operations. The current version is always available on this page, and the “Last updated” date above shows when it changed. Orders are governed by the Terms in force at the time the order is placed.
18. Severance and waiver
If any part of these Terms is held unenforceable, that part is read down to the minimum extent necessary, and the rest continues to apply. Our failure to enforce a right is not a waiver of it.
19. Governing law
These Terms are governed by the laws of [State/Territory, e.g. New South Wales], Australia, and the laws of the Commonwealth of Australia applicable therein. Nothing in these Terms limits rights that cannot be excluded under the Australian Consumer Law.
